These terms apply to your access to and use of messerand.com. Additional or different terms may apply to a particular service, proposal, contract, event, programme, publication, platform or separately operated group website. If specific written terms conflict with these general website terms, the specific written terms govern the relevant activity.

Acceptable use of the website

You may use this website for lawful informational and business purposes. You must not:

  • use the website in a way that violates applicable law or another person's rights;
  • attempt to gain unauthorised access to the website, its systems or connected services;
  • introduce malware, harmful code, automated attacks or an unreasonable technical load;
  • scrape, extract or reproduce substantial website content without permission;

No website content creates a fiduciary, advisory, employment, partnership, agency or other professional relationship by itself.

Enquiries, services, programmes and events

Enquiries are not acceptance

Submitting an enquiry, registration of interest, email or other website form does not guarantee a place, establish a contract or oblige Messerand to provide a service. An engagement is formed only when the relevant parties agree applicable scope, commercial terms and acceptance in an appropriate written form.

Separate terms may apply

Consulting services, executive education, conferences, travel, delegations, publications, sponsorships and partner-led activities may be subject to separate eligibility criteria, fees, payment terms, cancellation rules, privacy information and contractual documents.

Event information

Dates, venues, speakers, agendas, partners and formats may be changed where reasonably necessary. Any binding cancellation, refund or substitution rights will be stated in the specific registration or participation terms provided for that event.

Intellectual property

Unless stated otherwise, the website and its text, designs, graphics, photographs, videos, logos, trademarks, downloadable material, page structure and other content are owned by or licensed to Messerand and are protected by applicable intellectual-property laws.

You may view and make a reasonable personal or internal-business copy of website content for lawful, non-commercial reference. You may not republish, sell, license, modify, distribute, create derivative commercial works from or remove ownership notices from content without prior written permission.

Names and marks belonging to RSBPP, MCG Maritime & Energy Institute, Ukumbi Afrika, clients, partners or other third parties remain the property of their respective owners. Their appearance does not grant you a licence to use them.

Information and materials you submit

You are responsible for ensuring that information you submit is accurate, lawful and does not infringe another person's rights. You must have authority to provide personal information or materials relating to another person or organisation.

You retain ownership of material you send to us. You give Messerand permission to use, copy and share it internally or with relevant service and delivery partners only to assess and respond to your enquiry, administer the requested activity, comply with law or protect legitimate rights.

Do not submit confidential business information, protected intellectual property or sensitive personal data through a general website form unless we have requested it and agreed an appropriate method.

Website availability and security

We aim to maintain a useful and secure website but do not promise uninterrupted, error-free or permanently available access. We may suspend, withdraw, update or change all or part of the website for maintenance, security, operational or business reasons.

You are responsible for your own device, internet connection, security controls and backups. You should not assume that files or communications transmitted over the internet are entirely secure.

Responsibility and limitation of liability

To the fullest extent permitted by applicable law, Messerand is not liable for losses arising solely from reliance on general website information, inability to access the website, external websites, or unauthorised interference beyond our reasonable control.

Where liability cannot lawfully be excluded, it will be limited only to the extent permitted by law and assessed in light of the circumstances. Nothing in these terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that applicable law does not permit us to exclude or limit.

Specific contracts, registrations or engagement terms may contain different responsibility and liability provisions for the relevant service or event.

Changes to these terms

We may update these terms to reflect changes to the website, services, business or applicable law. The updated version will be posted on this page with a revised effective date. Continued use after an update means the new terms apply from that date.

Governing law

These terms are governed by the laws of the Netherlands. Disputes relating to these terms or use of the website are subject to the competent courts of the Netherlands, without affecting any mandatory rights or jurisdiction rules that applicable law grants you.

General

If any part of these terms is found invalid or unenforceable, the remaining parts continue to apply. A failure or delay in enforcing a provision does not waive the right to enforce it later. These terms do not give enforcement rights to a person who is not a party to them unless applicable law requires otherwise.
